It is essential to understand the terms and conditions under which charter
yachts operate. The use of “Venid-Yacht” website and of our travel services will
be taken as absolute acceptance of these Terms & Conditions.
1. On-line booking
When booking a charter online, the CHARTERER must fill-in a form asking for all
relevant information to the CHARTERERS’ identification, and in particular: full
name, mailing address, email and telephone number.
After choosing a yacht or holiday package, the CHARTERER must accept the present
Booking Terms and Conditions (by clicking on “I accept”) as well as any specific
conditions that could possibly be added to these general conditions for a
specific product or service.
The booking will only be fully registered once the payment of the deposit has
been registered by our bank. This last “click” is considered a valid electronic
signature.
All offers and orders are subject to availability. When an order is registered,
“Venid-Yacht” will send the CHARTERER an e-mail confirming the booking. In case
of unavailability, “Venid-Yacht” will contact the CHARTERER as soon as possible
to offer an adequate replacement product, another free start date or to confirm
that the booking has been canceled.
2. Deposit
30% non-refundable deposit will be required in all cases, to secure the desired
date of charter. A vessel is not considered booked unless a deposit has been
paid. The payment of a deposit for a charter will imply your acceptance of our
Terms & Conditions.
3. General Payment Terms
After the deposit has been paid and the contract undersigned it is mandatory the
payment of the balance be made no later than 7 days prior to the scheduled
departure date (departure date included). If the reservation is made less than 7
days prior to the scheduled departure date, the entire charter price shall be
due.
In the event that the balance is not paid within the stipulated time, the
contract will, by the operation of the law itself, and without formal notice, be
considered as canceled due to the fault of the CHARTERER. The deposit paid will
be retained and cannot be applied toward another holiday; the cancellation fees
will therefore then be payable under the terms of cancellation.

4. Prices
Except where specified in the offer, yacht charter prices include rental costs,
our taxes and the yacht insurance. If not specified in the offer, posted prices
do not include VAT, fuel, meals & beverages, tourist tax set by the authorities,
harbor fees, the service of a professional crew or captain, personal expenses as
well as additional insurance, third-party liability insurance. No protest
concerning the charter price will be considered. It is the responsibility of
each CHARTERER to decide, prior to his or her departure, whether or not the
price is acceptable to him or to her.
More generally, any service not expressly included in the yacht charter
description, as fuel, meals & beverages, yacht delivery fees, harbor fees,
airport transfers, airfare, crew gratuity, shore excursions / meals on shore
during the charter at the client’s request,.
5. Conditions of cancellation made by Charterer
If the tourist for any reason is unable to take the possession of the yacht, he
can, if previously agreed with “Venid-Yacht”, find another person who shall
instead of him undertake all rights and obligations deriving from this Contract.
Anyway the deposit will not be paid back. If a substitution can not be found
Chartereer shall retain 50% of the amount of charter fee and the total amount of
the charter fee if cancellation is made one week or less before the charter
startingdate.
6. Cancellations made by Venid-Yacht
If, by any reason Venid-Yacht fails to deliver the Vessel to the CHARTERER at
the Port of Delivery at the commencement of the Charter Period Venid-Yacht is
due of the full amount of payments made by the Charterer. If the deliver is late
the CHARTERER’s exclusive right will be to refuse the charter and receive
repayment without interest of the full amount of payments made by him.
Alternatively, if the parties mutually agree, the Charter Period shall be
extended by a time equivalent to the delay.

Delivery and redelivery fees may be applied to charters that require the yacht
to start or finish a charter away from its basic port.
9. Complaints
Should you wish to dispute the service provided during the charter, any claim
must be addressed at the latest by the last contractual day of your charter.
Only written complaints, signed by both parties on the occasion of return of the
yacht will be taken into consideration.
10. Arbitration
All the possible disagreements or disputes arising from/or in connection with
Charter party will be tried to settle by peaceful agreement. Eventual cases,
which cannot be solved peacefully, will be under Bulgarians court’s jurisdiction.
11. Crew Gratuity
As a general rule, the customary crew gratuity is 5-10% of the charter fee based
on service received and at your discretion. The gratuity should be handed to the
Captain for distribution to the crew members who work extremely hard to make a
successful charter.
